Under the Punjab Rented Premises Act, 2009 there are the following pre-requisite regarding eviction of a tenant in Punjab (Lahore)

1-    There Must be a tenancy agreement between the landlord and tenant

2-    The Tenancy must be registered in accordance with Punjab rented Premises Act, 2009

3-    The must be a dispute between the landlord and tenant

4- The landlord should have the ground for eviction mentioned in Punjab Rented Premises Act 2009

Let's discuss the process in case of any dispute between landlord and tenant. A landlord can ask for eviction if the term of the tenancy has become mature, and the tenant has violated the terms and conditions of the tenancy agreement.

Why Landlord Issues Eviction Notice

Before issuing an eviction notice. The Landlord should approach an advocate, practicing in specific cases as well as relevant law so that landlord can seek a useful opinion regarding the situation, thereafter, the landlord if thinks appropriate, should direct his counsel to serve an eviction notice.

Meaning of Eviction Notice

Eviction means and includes ejecting someone (tenant) from rented premises (Property Rented Out) in accordance with the law. Because to eject someone beyond the law, is deemed a severe violation of law and in such circumstances landlord should have to face the machinery of law against himself.

Eviction Notice and its Grounds

While issuing an eviction notice, a landlord should keep in mind the lawful reasoning justifying the ejectment of the tenant. The landlord should mention the reason in eviction notice why a landlord is serving an eviction notice. The following are deemed grounds for eviction.

a-    Tenancy has expired and the tenant is not ready to leave the rented premises despite the several reminders from the landlord.

b-    The Tenant has violated the terms and conditions of the tenancy agreement.

c-     The tenant has refused to pay the monthly rent to the landlord for many months or also failed to pay the arrears.

d-    Tenant is misusing the property/rented premises otherwise or in violation of tenancy agreement.

e-    Landlord received any complaint against the tenant regarding violation of any law.

30 Day Eviction Notice

The eviction notice should be served upon the tenant at least before thirty days or the time mentioned in the tenancy agreement. It is not illegality but an irregularity on the part of the landlord. 

How To Write An Eviction Notice 

An Eviction Notice can be addressed to a tenant or his authorized agent, Subject of notice should be clear and direct i.e. Eviction Notice and its consequences in case of default.

Conclusion

An eviction notice can only be served upon a tenant or his authorized agent when a landlord thinks that the tenant is misusing the property/rented premises in violation of law as well as tenancy or the tenant has breached the terms and conditions of the tenancy agreement, the tenancy has expired.
